A
Contrato de Arrendamiento in Spanish refers to the contract you sign for
a rented property in Spain. In a letting/rental contract one party (the landlord
or letting agent) agrees to let the use of a property for a specific length of
time and at an agreed price to another (the tenant). The letting of urban buildings
for housing or other purposes is regulated by the Spanish Law for Urban Lettings.
A
Letting/rental contract must include the following:
- Starting
date
- Name and identification details of the landlord
- Name
and identification details of the tenant
- Address
and details of the property
- Cost of renting
- Details
for payment of the rent (frequency etc)
- The length
of time the letting has been agreed (if this has not been stated it is one year)
- Specify
who is responsible for paying bills such as the community charge, real estate
tax etc.
It may also contain details of the
deposit (fianza) paid by the
tenant to the property owner or letting agent.
The
current law for Urban Lettings provides for the annulment of any clauses that
modify unfairly the norms set by this law.
