Legalisation of illegal immigrants in Spain

Today is the first day of the three month period set by Spain's Socialist government to enable illegal immigrants to legalise their residence in Spain.

Illegal immigrants who can prove they have been living in Spain and have been registered with the municipal authorities (empadronados) for at least 6 months, have no criminal record and can produce a contract have a three month deadline to apply for residence and a work permit. 160 Social Security offices, normally open to the public from ten a.m. to one O'clock p.m., will open in the afternoons and early evenings to deal with the flood of applications they expect to receive as from today. Applications must be handed in by the employer rather than the foreign worker.

In order to receive medical care, apply for residency or schooling, everyone in Spain has to be registered with their local "padron", (municipal registrar). According to figures released by the municipal registers in Spain, over three million immigrants are registered with a Spanish address. The number of immigrants with legal residence permits in Spain is 1.8 million. The difference between the two figures illustrates just how many illegal immigrants are living in Spain.

The Spanish government has designed its immigration policy in close collaboration with trade unions and private sector employers, and the only political party to speak out against this one-off measure is the Popular Party. The opposition party argues that Spain has not got the resources to give education, health and other services to unlimited numbers of immigrants. But the government claims that today's measure will force thousands of immigrants out of illegal employment as for the first time employers will have to start paying their national health payments which will, in turn, contribute to the cost of public services which the illegal residents are already using. It will also put an end to exploitation of immigrant workers by employers who take advantage of their illegal situation to pay poor wages and demand long hours in poor working conditions. Employers who do not legalise the situation of their employees in the next three months risk fines of up to 60.000 euros.

I appreciate this legislation. It's something to take a positive step to sort out a mess of human misery.

BUT ONE THING DOES NOT CLARIFY ME, HOW AN ILLIGAL IMMIGRANT PROVE THE THINGS YOU ASKED FOR.

1)
ILLIGAL PERSON DO NOT HAVE THEIR RECORD TO PROVE THAT THEY ARE LIVING IN SPAIN MORE THAN SIX MONTHS . ALTHOUGH, THEY ARE LIVING THEIR FOR LONG TIME. S/HE DIDN'T KEEP IT AS S/HE IS ILLIGAL AND FRIGHTEN IF RECORD HELP THE AUTHORITY TO CATCH HIM UP. WORKS CASH IN HAND. CAN YOU EXPLAIN PLEASE. WHAT DOC DO THEY NEED TO PROVE.

MINIMUM SIX MONTHS WORK CONTRACT IS REQUIRED. ONE THING NEED TO BE CLARIFIED THAT YOU MUST KNOW THAT TO GET A WORK OR CONTRACT, ONCE MUST NEED LEGAL PAPERS FIRST, NOT FIRST CONTRACT THEN LEGALIGATION BUT ON THE OTHER WAY. CAN YOU PLEASE CLARIFY ME HOW THIS KIND OF SITUATION WOULD BE SORTED.

MANY HISHONEST BUSINESS MAN HAS STARTED TO SELL THE WORK CONTRACT (10,000.00 eURO PER CONTRACT. SPANISH GOV SHOULD DO SOMETHING ABOUT IT. YOU TOOK THE DICISION TO HELP THE VOLNURABLE PEOPLE PLEASE LET THEM BE HELPED. DO SOMETHING NOT BE BLACKMAILED THE DISHONEST BUSINESS PEOPLE.

The way illegal immigrants have of proving they have lived in Spain for more than six months is by a CERTIFICADO DE EMPADRONAMIENTO. This is obtained from the local Ayuntamiento. To obtain it you have to show the padron paper you were given when you registered. Many illegal immigrants do have a padron paper because they registered to get health and education services.

As far as the contract is concerned, usually in the past you needed to be a legal resident to obtain a contract. But this time you just need to have a six-month contract from an employer willing to employ you. In seasonal (agriculture) and domestic jobs, this is different. If you can prove that you have a minimum number of hours paid work per week, you can apply for residence.

I agreed and appreciate the administration department who fix these terms..specially six months old proof whic is with munipal department..cuz in past money making groups actives to make fake proofs and got lot of money from innocent peoples..however,,,this is nice.

process is goog but due to requirement of work permit(contrado) it taking time so i strongly recommend to extend time for submission of documents one or two weeks more. because to find out contract its hard job...cuz employer asking money for providing work contract..now time is expiring and employer providing work contract to foreign workers. and peoples requesting to extend some time for submission of documents.

I STRONGLY RECOMMEND TO EXTEND DOCUMENTS SUBMISSION TIME. BECAUSE DUE TO WORK PERMIT CONDITIN MANY PEOPLES ARE THERE WHO COULD NOT SUMBIT DOCUMENST DUE TO WORK PERMIT.BECAUSE EMPLOYER SELLS THEIR CONTACT AT HUGH AMOUNT. NOW THINGS ARE DIFFERNET AND EMPLOYER PROVIDING CONTARCTS ON LOW PRICES ARE WITHOUT MONEY. I REQUEST TO SPANISH GOVT. PLS EXTEND TIME.

Hi there, i know that this might sound a bit silly but i have been looking everywhere for answers and this seems like the only place i can actually get some. I am 15 at the moment but am planning to leave to move to spain next summer and i will be 16 by that point, i am moving over with my partner and his parents. Will i be able to find work over there at 16 or is it true that you have to go to school untill you are 18.
